台開限期內未補繳3本財報 金管會開罰72萬元

〔記者王孟倫／台北報導〕已經遭到證券交易所於今年8月4日強制下市的台開公司，又吞下金管會罰單。金管會今天（9月20日）公告，台開未依規定在期限內，補行公告申報110年度、111年第1季及111年第2季財務報告，因此，依「證券交易法」第178條第1項第4款及第179條規定，處台開公司行為之邱姓負責人新台幣72萬元罰鍰。
金管會表示，依據「證交法」第36條第1項第1款及第2款規定，依本法發行有價證券之公司，應於每會計年度終了後3個月內，公告並申報經會計師查核簽證、董事會通過及監察人承認之年度財務報告；另外，應於每會計年度第1季及第2季終了後45日內，公告並申報經會計師核閱及提報董事會之財務報告。

若未依「證交法」第36條第1項第1款及第2款規定製作、申報、公告、備置財務報告者，處24萬元以上480萬元以下罰鍰，並得命其限期改善；屆期未改善者，得按次處罰。
金管會指出，經查，台開公司未依照規定補行公告申報110年度、111年第1季及111年第2季共三本財務報告，因此，依法予以開罰合計為72萬元。
